1. Acceptance of Terms
By creating an account on PeakLevs or using our mobile application or website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use the service.
2. Eligibility
You must be at least 13 years of age to use PeakLevs. If you are located in the United Kingdom or the European Economic Area, you must be at least 16 years of age. By creating an account, you represent and warrant that you meet these age requirements.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information when registering
- Keep your account information up to date
- Not share your account credentials with anyone else
- Not create accounts on behalf of other people
- Not create multiple accounts for the purpose of manipulating scores or leaderboards
- Notify us immediately if you suspect unauthorised use of your account
4. Acceptable Use
You agree to use PeakLevs in accordance with applicable laws and our Community Guidelines. Specifically, you agree not to:
- Use the service for any unlawful purpose
- Harass, threaten, bully, or intimidate other users
- Post content that is offensive, obscene, hateful, or otherwise inappropriate
- Attempt to manipulate your Levs score through dishonest or fraudulent means
- Submit false or misleading action logs or proof photos
- Create automated or bot-driven accounts or submissions
- Attempt to reverse engineer, decompile, or exploit the application or its infrastructure
- Interfere with or disrupt the service or servers
- Scrape or collect data from other users without consent
5. Content You Create
You retain ownership of all content you post on PeakLevs, including action descriptions, proof photos, and profile information. By posting content on the platform, you grant PeakLevs a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, reproduce, and distribute your content within the service and in related marketing materials.
You represent that you have the right to post any content you submit and that your content does not infringe on the rights of any third party.
6. Subscriptions and Payments
PeakLevs offers free and premium tiers. Premium subscriptions and lifetime purchases are processed through the Apple App Store or Google Play Store. All billing, payment processing, renewal, and cancellation procedures are governed by the respective platform's terms and policies.
- Monthly Subscription: £9.99/month (or local equivalent). Automatically renews unless cancelled at least 24 hours before the end of the current billing period.
- Lifetime Purchase: £100 (or local equivalent). A one-time payment granting permanent access to all premium features.
Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
7. Levs Score and Tiers
The Levs scoring system is designed to reflect genuine real-world actions. We reserve the right to adjust scoring algorithms, tier thresholds, and related mechanics at our discretion to maintain the integrity and fairness of the platform. We may also reset, adjust, or remove scores from accounts found to be engaging in fraudulent or manipulative behaviour.
8. Account Deletion
You may delete your account at any time through the Settings screen in the app. Upon deletion:
- Your personal data will be permanently removed within 30 days
- Your Levs score, action logs, and proof photos will be deleted
- Your leaderboard ranking will be removed
- Any active subscription will need to be cancelled separately through Apple or Google
9. Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or our Community Guidelines. We reserve the right to remove content that violates our policies without prior notice. In the event of termination for cause, you will not be entitled to a refund.
10. Intellectual Property
PeakLevs, including its name, logo, design, scoring system, tier structure, and all related intellectual property, is owned by PeakLevs. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.
11. Disclaimers
PeakLevs is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not warrant that the service will be uninterrupted, error-free, or free from harmful components. We make no representations about the accuracy or reliability of user-generated content.
12. Limitation of Liability
To the maximum extent permitted by applicable law, PeakLevs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding any claim.
13. Indemnification
You agree to indemnify and hold harmless PeakLevs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of PeakLevs shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, legal requirements, or the functionality of the service. We will notify you of material changes via email or in-app notification. Your continued use of PeakLevs after the effective date of any changes constitutes your acceptance of the updated Terms.
